Terms and Conditions

1.         Introduction

Welcome to Skill Synergy Marketing Solutions ("we", "our", "us"). By subscribing to our services, you ("Client", "User") agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

2.         Definitions

Platform refers to the SaaS infrastructure provided via Go High Level (GHL) and managed by Skill Synergy Marketing Solutions.

Client Data refers to any content or information uploaded, entered, or processed by the client within the platform.

Subscription refers to the billing and service agreement between the client and Skill Synergy.

 

3.         Services Provided

We provide marketing automation, CRM, website/funnel building, communication tools, and related services via our SaaS platform powered by GHL. Services include but are not limited to:

• CRM and Pipeline Management

• Calendars and Appointment Scheduling

• Email and SMS Marketing Automation

• Funnels and Website Hosting

• Forms, Surveys, and Workflows

• Client Portals and Reputation Management Third-party integrations (e.g., Google, Facebook, Stripe, PayPal, Wise, etc.) are subject to the terms of those providers.

 

4.         User Responsibilities

By using our services, you agree to:

• Provide accurate information during onboarding and maintain updated account details.

• Use the platform in compliance with all applicable laws, including Philippine Data Privacy Act (DPA), Canada’s PIPEDA/CASL, and the U.S. CAN-SPAM Act and data protection regulations.

• Maintain the confidentiality of your login credentials.

• Not misuse, duplicate, reverse-engineer, or resell the platform or its assets.

• Obtain appropriate consent before sending marketing messages to your clients or prospects.

 

5.         Payment & Subscription

• Services are billed on a recurring monthly or annual basis unless otherwise agreed in writing.

• All pricing for Philippine-based clients is inclusive of 12% VAT as required by local tax regulations. Prices displayed during checkout reflect the final amount to be paid, inclusive of tax.

• Clients based outside the Philippines (e.g., in Canada or the U.S.) will not be charged VAT or sales tax, as we are not registered to collect taxes in those jurisdictions.

• Payment is due upon subscription and on each recurring billing date thereafter. Accepted payment methods include credit/debit cards, PayPal, and other supported third-party processors.

• All payments are non-refundable unless otherwise required by applicable law or explicitly stated in a separate written agreement.

• Late or failed payments may result in temporary suspension or permanent termination of services. We will make reasonable efforts to notify you prior to suspension.

 

6.         Cancellation & Termination

 

• You may cancel your subscription with a 7-day written notice prior to your next billing cycle to avoid additional charges.

• We reserve the right to terminate or suspend your account for:

◦ Non-compliance with these Terms & Conditions

◦ Illegal or unethical use of the platform

◦ Failure to pay invoices after reasonable notice

 

7.         Data Ownership & Privacy

 

• You retain ownership of your client data. We will not sell or share your data with third parties.

• Our infrastructure partner, Go High Level (GHL), is compliant with industry security and privacy standards.

• Clients are responsible for ensuring that their use of the platform is compliant with applicable privacy laws, including:

◦ Philippines: Data Privacy Act of 2012 (RA 10173)

◦ Canada: PIPEDA and CASL

◦ United States: CCPA, CAN-SPAM, and other state-specific laws

• In the event of a data breach, you will be notified as required by applicable law.

 

8.         Intellectual Property

• All Skill Synergy branding, resources, custom workflows, templates, and materials remain our intellectual property.

• These may not be duplicated, sold, or distributed outside of your licensed subscription.

• You may use the templates and workflows solely within the bounds of your service agreement.

 

9.         Limitations of Liability

• We provide services on an “as is” and “as available” basis without warranties of any kind.

• We are not liable for indirect, incidental, or consequential damages including but not limited to data loss, missed opportunities, or business interruption.

• In no event shall our liability exceed the total fees paid by the client over the last 12 months.

 

10.    Support & Service Levels

 

• Standard support is available via chat, email, or ticket within business hours: Monday–Friday, 9AM–5PM PHT (GMT+8).

• Emergency or after-hours support may be offered for critical platform failures at our discretion.

• We are not responsible for outages or delays caused by GHL, hosting providers, or third-party services.

 

11.    Communications & Consent

 

• By using our platform, you agree to receive transactional emails and service-related updates.

• You may opt in to promotional updates and unsubscribe at any time.

• All SMS/email marketing messages sent through the platform are subject to local anti-spam laws. Clients are responsible for securing proper consent from recipients.

12.    Governing Law

These Terms & Conditions are governed by the laws of the Republic of the Philippines, without regard to its conflict of laws. For international users, your local laws may still apply regarding consumer protection and privacy.

13.    Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or platform alert. Continued use of our services after such updates indicates your acceptance of the new terms.
